BREAKING NEWS – IMMIGRATION UPDATES MAY 27, 2020

As we go to immigration almost daily in Chapala and Guadalajara, we try to make heads or tails out of the ever-changing policies.  

Daily we receive hundreds of calls, emails, whatsap, instant messages, PMs, etc. 

Everybody wants to know what to do, how to comply with the law, how to deal with expired documents and when they can or should travel.  

As we are talking about a global pandemic, we need to take into account many layers of government and policies.  Someone in Mexico must factor in federal laws, state and local laws. For travel one then needs to do the same for their proposed destination as well as any place they may have a layover with flights and routes being changed and canceled daily.  

Here in Mexico, there have been many landmark dates that have come and gone, with pending landmark dates of June 1st for proposed reopening of certain places, June 15 when the federal courts extended their reopening, June 21 for US / Canadian border crossing restrictions and August 1 mentioned by the president.  

Each immigration office has handled the reissuance of tourist visas differently.  As of today, the policy is they will only reissue for people over 60 who can show why they could not go home. This current program is only for people with expired visas and is set to end this Friday, May 29, 2020.  

Depending on the development of the issue, it could be reinstated again in a week or so.  Immigration is not seeking out foreigners to deport them.  The reissuance procedure may be a bit tedious, there were large lines at immigration in Guadalajara today and the process requires forms to be filled out, a hearing with an immigration officer and then a resolution must be issued and then the head officer prepares and signs the new tourist visa.  Plan to spend 3-5 hours at immigration.  Each time the program is offered the line gets longer.

Immigration has been reissuing tourist visas for 180 days from date of issuance, not from the date that the old visa expired.  Immigration is admonishing people to not be lollygagging in Mexico.  Tourists should return home at the first available moment.  

In other news, today in the Diario Oficial de la Federacion or Mexico’s Federal Register, there was a decree to suspend all time deadlines for immigration for all temporary and permanent resident inside or outside of Mexico.

We have seen the application of this with clients whose documents expired and they did not have to pay a fine nor regularization fee due to a suspension of deadlines but without any cited authority.  The suspension now has a sort of specific start date, June 1, although there has been some retroactive application. The end date may be subject to regional policies which may leave the door open to uncertainty for the average person who wants to have specific dates so they know when they may enter the country to renew or process their documents and not be turned away or told to come back later after making an international journey.  

The suspension of deadlines is from June 1, 2020 until the health authorities determine that there is no “epidemiological risk” relating to the gradual opening of activities relating to the Federal Public Administration.  

As with everything, we will see how this will be applied.  Logically this should benefit people who have applied for visas at consulates outside Mexico who have a 180-day time limit to enter the country who have been unable to travel.  Also, there are people who need to renew their temporary visas or those that left on travel letters and who have been unable to return within the 60-day time limit.

In PV and Riviera Nayarit, new 180 day FMM's are being issued as humanitarian, for no cost providing a letter is submitted stating why needed. In PV they take 2 days. In Riviera Nayarit they take 2 weeks. There is no cost. Teresa who works for me, submitted as recent as this week. 

In San Miguel, INM renews FMM's taking 3 weeks and 3 fees. I have completed several and submitted as recent as today.

At Aduana in Queretaro new car permits are issued either once one starts FMM renewal or when issued. In PV they will not issue new car permits. Yet, when calling Aduana in Mexico city car permits are to be issued but deposit lost. Ask for Ana Mora Aduana in Mexico City 1-877-448-8728 options 7 and 8. The others in the office are not as informed. I believe the rationale for issuing new TIP is based on the following.

Article 106; Fracciónes 17.1 & 17.4,

17.1.- Para estos efectos la prórroga de la vigencia del permiso de importación temporal del vehiculo se acreditará con el documento oficial que emita la autoridad migratoria, sin que se requira autorización de las autoridades aduaneras; en este caso, el permiso de importación temporal se mantendrá vigente aún y cuando el importador haya obtenido cambio en la calidad migratoria de no inmigrante a inmigrante rentista, (Residente Temporal), siempre que exista continuidad en las calidades migratorias.

17.4.- En caso de que el trámite de importación temporal se haya efectuado mediante tarjeta bancaria, y la documentación esté completa, el responsable del CIITEV de la aduana que corresponda, procederá a informa al interesado que no es necesario la presentación de dicho aviso, en virtud de que su vehiculo se encuentra legal en el territorio nacional mientras continúe vigente su calidad migratoria, incluyendo sus prórrogas, ampliaciones o refrendos.”

INM is open in San Miguel. So the post above is not relevant to all INM offices.

Unless of course one wants/needs to actually get something done.... like get an expired Tourist Card  and TIP 'renewed'  and then it might be of some importance that folks know that they can drive to SMA for that service. She mentions elsewhere that this is being done.  

So if this shoe fits, it DOES have something to do with Chapala.....

There are people here that can do INM  like the OP Spencer when the office is open here or GUADALAJARA. That shoe pretty much fits. I'm pretty certain that nobody is interested in going to PV or SMA . Nope,nothing to do with Chapala by any stretch of the imagination.

The most recent was in the past week with no issues driving. And the point is which you missed is there is a huge lack of consistency when Spencer states INM is closed as obviously it is not elswhere!!! And there are options vs being illegal and car subject to confiscation and insurance null and void in the event of an accident.

Nice try and lovely scare tactic. He has clearly stated that he uses Guadalajara. He has full service law offices here and in Guadalajara staffed with other lawyers and knowledgeable clerical staff. Driving to SMA  from Chapala makes no sense.

You think I do not know Spencer? Geesh I send him business regularly. He and his wife have been here in San Miguel with us.

There have been times he has been unable to renew FMM's stating offices closed and FMMs were to be stopped at end of April. And he stated: "Immigration has been reissuing tourist visas for 180 days from date of issuance, not from the date that the old visa expired." That creates a huge issue for people when elsewhere they are issued with a full 180 days.

There are different options for different people depending on their situation, some may want to drive to get a solution they cannot get locally.  Im glad we share information and have solutions so that if I cannot do something I can at least let people know who else may be able to help them

Spencer McMullen:  Our foreign plated car has been in Mexico coming on 4 years in September.  Due to covid-19 restrictions on hotels, and higher risk of infection from staying in many hotels along the way, we may have difficulty going back to Canada by the deadline.  Do you know if it's possible to apply for a TIPP extension?  Or another solution?  Thanks

How many times do you have to be told that us canuckleheads do not say  " gooin oot and aboot"? It's New Englanders that mess up like that. We canucleheads speak the Queens English and "go out and about" or don't bother going "out" while we're doing it. Do you not have an "awnty"in New England with a "ruff" on her house? SNORK!

No, it is not possible to extend a TIP with no current TR card.  You may go to Laredo and start over proving financials for a temporary resident visa.

I referred a person to Spencer today for a new FMM but apparently, his response was renewals had ended there. They are still being issued in San Miguel, Riviera Nayarit and PV. So far in Queretaro, TIPs are also being renewed.
