My gardener has an increasing problem with alcohol. Over the weekend he did a side job for me and was drinking heavily. He did not show up yesterday for his regular job. My guess is he was drunk. This is the first time he has not shown up without calling first. I cannot allow drinking on the job. If I fire him do I have to pay severance?

Give him a warning in writing and have him sign a copy. It is my understanding that after three warnings you can fire an employee without compensation. Be very careful.a mis-step can be costly.

If you have a lawyer, contact him/her now for the correct way to handle this situation. If you don't have a lawyer, get one. It's very, very tricky to document 'cause' and you do not want to end up needing a lawyer after the fact.

It is an interesting subject, I consulted a lawyer recently who told me that the best protection you can have is a good relationship wit the employee which of course you do not have when you let them go...
It seems that if you are a wealthy Mexican you can get away with far more than a foreigner so by all means consult a lawyer.
