can my mexican girlfriend (soon to be wife) drive my NOB plated car?

does it matter if I am with her when she is driving it?

My understanding is that she may only drive the car when you are with her as long as she is your fiancé. Then, after you are married, I think that she can drive it alone as a family member; but you had better check that part to be sure that it does apply to a Mexican national. In any event, be sure she is listed on your insurance policy.

As I understand the law, Mexican citizens can only operate foreign plated vehicles if:

1. They have foreign status, such as a US green card, or
2. The owner of the vehicle is in the car.

If you are only asking about Lakeside, I suspect there is little to be concerned with, as the Transito appears to not enforce many laws, except when a few officers might want to put some money in their pockets.

Also agree but would add that few transitos probably know the aduana law.

I think this is the wrong place to be asking your question. To get a definitive answer, it would probably be best to contact the Aduana or a lawyer. It has been many years since we had cars with NOB plates here and my memory is a little murky, but there is a list of people that may drive your NOB plated car which includes your antecedents (parents), decendents, siblings, and I believe it includes your spouse.
Any other Mexican citizen may drive the car as long as the import permit holder is present.

We imported two cars at different times, a couple of years apart. The import permits for both of our cars were in my name, that was illegal as hell, but the jerks at the Aduana office insisted that the second car be imported in my name and not my Mexican wife's name even though a Mexican citizen that could prove that they did not reside permanently in México could temporarily import a foreign plated car at that time.

My wife has a green card, and we do maintain a permanent residence address in Alaska. The staff at the Aduana office were ignorant of the law, and since the vehicle import records were not computerized at that time, we imported the second car in my name. We never had any problems, and later both cars were nationalized under two different amnesties. Later, a third car was temporarily imported and later nationalized using my wife's name.

Both of the cars we originally imported were registered in both of our names in Alaska. I don't remember if that was a requirement to make it legal for my wife to drive both cars here. Until your marriage it will definitely be required that you are present while your fiancé is driving the car. It will be best to consult a lawyer or the Aduana to determine if your spouse is automatically allowed to drive it after your marriage, and if proof of the marriage will need to be carried in the car when she is driving it.

Thanks Rolly. Best information yet and you don't want to fool around with who can and can not drive your car...unless you want to lose it.

What about car mechanics...do they have any special permission to drive our cars for pickup and return?
