SUBJECT: The Sixth District Court of Federal Criminal Proceedings in the State of Baja California, located in Tijuana, at the request of the Public Prosecutor of the Federation assigned, who asked not accusatory conclusions, decreed the acquittal in the criminal case 114 / 2014 initiated against Andrew Paul Tahmooressi for various offenses under the Federal Firearms and Explosives, ordering his immediate release this date. Thus, the court lifted the custody and pursuant to Article 303 of the Federal Code of Criminal Procedure, immediate and absolute freedom are ordered with respect to criminal proceedings initiated against 114/2014 for offenses following: A) Carrying two guns for the exclusive use of the Army, Navy and Air Force, and sanctioned in Article 83, Sections II and III, in relation to 11, b ) and c) of the Federal Firearms Act and Explosives, aggravated to the ninth paragraph of paragraph 83 of the said special law is concerned. slainte39 Posted November 1, 2014 Report Share Posted November 1, 2014 From what I have heard on the news reports, the experts for the prosecution reported back that Tahmooressi does have mental problems. Still one could speculate that part of the decision could be political. Let's hope his mother keeps him home and that he gets proper therapy. Supposedly they evaluated him with some type of phobia that requires him to want to be heavily armed at all times. I'm sure they were convinced that he wasn't some sort of arms dealer or smuggler. Xena Posted November 1, 2014 Report Share Posted November 1, 2014 As for his mom´s pickup truck, who knows. Perhaps Mexico, like the U.S., can keep property of those arrested under certain charges. In the U.S. it is drug charges. Maybe here it is possession of illegal firearms. Some DEA and local law enforcement officials in the U.S. are driving luxury cars and boats confiscated under the law. I just hope he receives the help he needs and is not allowed to rebuild his arsenal. As it now stands he appears to be a danger to himself and others.
